Terms & Conditions

Clear agreements create a smooth customer experience. These Terms & Conditions apply to all products and services provided by SongChoice.

1. Scope

These Terms & Conditions apply to all quotations, orders, agreements and deliveries made by SongChoice.

By placing an order, you confirm that you have read and accepted these Terms & Conditions.

2. SongChoice Services

SongChoice provides personalised digital music products, including:

  • Personalised songs
  • Song lyrics
  • Instrumental versions
  • Karaoke videos

Every product is created using the information and instructions provided by the customer.

3. Formation of the Agreement

The agreement becomes effective once:

  • the customer places an order;
  • payment has been successfully completed;
  • SongChoice has received the order.

4. Prices

All prices displayed for private consumers include VAT where applicable.

Prices shown for business customers are presented in accordance with applicable tax legislation.

SongChoice reserves the right to change its prices at any time. Price changes will not affect orders that have already been placed and paid for.

5. Payment

All payments are securely processed through Mollie B.V.

Production of your order will begin only after successful payment has been received.

6. Delivery

Standard Delivery:
Approximately 3 business days.

Express Delivery:
Approximately 24 hours.

Delivery times are estimates and should not be regarded as guaranteed deadlines.

7. Revisions

SongChoice strives to deliver the highest possible quality with every personalised production.

Minor revision requests may be carried out free of charge, provided they are reasonable and remain within the scope of the original order.

Additional requests or substantial changes that fall outside the original order may be treated as additional work and may incur extra charges.

8. Right of Withdrawal

As SongChoice creates personalised products made specifically to your requirements, the statutory right of withdrawal no longer applies once production has started.

This exclusion is based on Article 6:230p of the Dutch Civil Code, which excludes the right of withdrawal for products manufactured according to the consumer's specifications.

9. Intellectual Property

Upon full payment, the customer receives a personal, non-exclusive licence to use the delivered product for its intended purpose.

All underlying technologies, production methods, software, designs and creative processes remain the exclusive property of Power Sales Marketing (PSM25).

The customer may use the completed product for personal purposes and for the purpose for which it was originally commissioned. Commercial use, public distribution, resale, sublicensing, redistribution or any other business-related use of the delivered product is permitted only with the prior written consent of SongChoice.

10. Limitation of Liability

SongChoice shall be liable only for direct damages resulting from intentional misconduct or gross negligence.

Any liability shall in all cases be limited to the amount paid for the relevant order.

SongChoice shall not be liable for indirect damages, consequential damages, loss of profits, loss of revenue or any other form of indirect financial loss.

11. Customer Materials

The customer warrants that all texts, images, audio files and any other materials supplied to SongChoice do not infringe the intellectual property rights or any other rights of third parties.

The customer agrees to indemnify and hold SongChoice harmless against any third-party claims arising from materials supplied by the customer.

12. Privacy

Personal data is processed in accordance with the SongChoice Privacy Policy.

13. Force Majeure

SongChoice shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

Force majeure includes, but is not limited to:

  • Internet outages;
  • Power failures;
  • Service interruptions affecting suppliers or third-party providers;
  • Technical failures beyond the reasonable control of SongChoice;
  • Illness;
  • Natural disasters;
  • Government actions or restrictions.

14. Amendments

SongChoice reserves the right to amend these Terms & Conditions at any time.

The most recent version will always be available on SongChoice.nl.

15. Governing Law

These Terms & Conditions and all agreements entered into with SongChoice shall be governed exclusively by the laws of the Netherlands.

Any disputes shall be submitted exclusively to the competent Dutch courts.
